I had earlier filed an affidavit before Justice Ranganath Mishra Commission of Inquiry. I am shown a copy of that affidavit it bears my signature. I identify my signature. I have nothing more to say than what I have stated therein.

Cross examination by S.S. Gandhi, Senior Advocate on behalf of Delhi Police

It is true that on 4.11.84 my complaint was recorded as FIR No. 412/84. It is true that my statement was recorded twice during the investigation of that case FIR. I do not remember if a separate case being FIR No.44/87 was recorded in respect of the loss caused to my property. It is not true that my statement was recorded on 6.11.84. I my complaint I had named Hari Chand Saini and Kherati Lal Arora as the accused.

When the case was put up in the court, some other persons were brought as accused before the Court. It is true that I had not named Vijay Choudhary in my complaint to the police. I cannot explain how the name of Vijay Choudhary had appeared in my affidavit. I do not know English nor do I know Punjabi. It is true that after my affidavit was prepared in Punjabi its contents were not read over to me, merely my signatures were taken thereon.

I had told the person who was preparing the affidavit about the loss to my property. I was told that whatever loss was suffered by me was incorporated in the affidavit. When I was informed about the loss of my property by my employees I wanted to go near the place where my trucks were standing and verify as to whether that information was correct. While I was on way to that place I was prevented by the mob.

Thereafter I wanted to go to that place by taking another route. There I was prevented by S.I. Shakti Singh from going further and I was told to better go back as it is the work of the police to find out what has been done in respect of the articles. I was not allowed to go and, therefore, I returned to my house.

I had also told that person who had prepared my affidavit that the persons who had caused damage were Hari Chand and Kherati Lal. I had not named anyone else. I had not told anything else to the person who had prepared my affidavit.
