Statement submitted before the Nanavati Commission

I am filing this affidavit before this Commission. The affidavit is taken on record and marked as Exhibit No.W31/1.

Cross examination by S.S. Gandhi, Sr. Advocate on behalf of Delhi Police

I had given a complaint to the police at Shidipura Police Chownki after four or five days after the incident. Shidipura Police Chowki falls within the jurisdiction of Desh Bandhu Gupta Road, Police Station. I do not know if the police had registered an offence in respect of burning of the shop at Rani Jhansi Road at 11.55 pm on 31st October, 1984.

I do not know if it was registered under FIR No.519/1984. At the time of the complaint, and thereafter no other evidence was given by me. I had not witnessed any incidents of rioting on the way from my house to my shop which is in Subhash Nagar on Rani Jhansi Road on 31st October, 1984. I have not noticed any incident of rioting even while returning to my house. About 16 to 17 shops were burnt on that day.

On 31st only my shop was burnt and it was burnt partially. My shop was completely burnt along with other shops on 1st November, 1984. Shop No.13 was on the back side and is about 350 ft. away from my shop. Shop No.71 was also away by some more distance from shop No.13. I do not know if any other shop nearby locality was set on fire on 31st October, 1984. On 31st night fire brigade came to extinguish, the shops which were set on fire.

The house of Banarasi Das is opposite to my shop and about 150 ft away. It is not correct to say that the police had come near my shop on 1st November, 1984 in the morning and they had lathi charged to disperse the mob. I do not know if FIR No.594 of 1984 was registered regarding the incident. I do not know if police had arrested 41 persons in connection with the incident.
