On SA
I have earlier filed an affidavit before this Commission. In addition to what I have stated therein I say that after I had received injuries I had stayed with my neighbour for two days and thereafter I had approached the police. I had approached the police for help as I apprehended danger to my life. The police refused to help me and told me that I should go away from there to Delhi Cant.
The police had also asked me that as to how I was saved. I had again gone to police station on 10/11 November, 1984 for lodging a complaint. At that time the police recorded only those things which were relating to the loss caused to my property. They had refused to take down my complaint regarding the injuries sustained by me.
Cross examination by S.S. Gandhi, Senior Advocate on behalf of Delhi Police
I do not remember if I had filed any affidavit earlier before any authority or Commission. I had earlier given a statement before the person who used to come to Gurdwara to find out who had received injuries and whose properties were either looted or burnt. I know little English, I can read it. I cannot read and write Punjabi but I can understand. My affidavit was prepared at the Gurdwara.
Whatever was written in it was read over to me and thereafter I had signed it. Whatever had come to my mind at that time was stated in that affidavit. When I had gone to the police station I had met the police officer who was on duty there. I had not at that time complained to any higher officer about that officer not taking down my complaint as the situation was such that I had not felt like doing so.
When I had again gone to the police station I had seen one person who was writing complaints; I had told him about the incident wherein I was injured and my house was burnt. He thereafter wrote down something and gave one copy of it to me. The policeman had thereafter put a stamp on it. At that time I was told by the police that I should state only about the loss caused to my property.
I had told the person who had written down my complaint at the police station that the mob did carry arms like, sticks, iron rods, swords etc. I had told that person that I had tried to prevent those persons from attacking my shop by closing the door of my shop but I was not successful. I had also told them that I was severely beaten by the mob. I had also told him that my shop was burnt and some of the goods from my shop were looted.
At that time my estimate of loss was Rs.40,000.00 so I had disclosed that amount to that person. I had told all these facts to that person. I had told many other things to that person. I had told that person that my brother was also beaten by the mob. I had also told him about the attack on my uncle and other family members. I had not given the names of the person who had committed such acts as I do not know them.
Read over and found correct.
