I had filed an affidavit before Justice Ranganath Mishra Commission of Inquiry. A photocopy of it is shown to me. It bears my signature. Its contents are correct. I have nothing more to say. The same may be read as part of my examination-in-chief.
Cross examination by S.S. Gandhi, Senior Advocate on behalf of Delhi Police
The distance between my house and factory is about 100 ft. It is true that on the basis of the complaint an FIR was registered.
[Mr Gandhi states that the number of that FIR is 263/92] [Mr Gandhi also states that an general FIR was also registered by the police and its number is 414/84].
The police had recorded my statement during the investigation of FIR No.263/92 and I had identified the accused also. Thereafter I had not been called as a witness in the court. After the incident I had not returned to that locality and I had hired another house. I had not received any summons from the court. I had noticed two policemen on their motorcycle. They had come with the mob. The crowd was raising shouts such as ' Maro' 'Maro' – ' Mardiya' 'Mardiya'.
The opposite house in which I had taken shelter was about 25 ft. away from my factory and house. I had seen the mob when it was 20 ft away. It is not true that I had noticed the crowd approaching from a distance of about 1000 yards. The policemen were with the mob when I had seen them. I had not seen the policemen coming along with the mob. After reaching the Gurdwara on 5.11.84, I had lodged my complaint/statement with the police after about 4 to 5 days when the police had come there.
Read over and found correct.
