I, Nihal Singh S/o S. Mukand Singh, aged about 50 yrs., R/o 586, Moti Ram Marg, G.T. Road, Shahdara, Delhi, do hereby solemnly affirm and declare on oath as under: -1
1. That I am residing at the aforesaid address since 1953 and A.M. carrying on the business of trading in steel scrap.
2. That on 1-11-84, in the morning my neighbour came to my house and told me that a mob is stationed at G.T. Road nearby and killing Sikhs after dragging them out of buses. They prevailed upon me to leave the house along with family members lest some harm may come to us. We sought refuge in the house of Suraj Bhan Gulati my immediate neighbour and hid myself and my family there.
3. That from the roof of Gulati's house I saw that the following persons were looting the godown of M/s Mahindera & Mahindera: -
1) Pt. Arjan Das
2) Ravi S/o Pt. Arjan Das
3) Gandhi S/o Pt. Arjan Das
4) Ghoga S/o Pt. Arjan Das
5) Rajinder S/o Pt. Arjan Das
6) Jawahar, Sanitary Inspector of Mansarovar Park, Shahdara.
7) Puran, a bad character of Mansarovar Park, Shahdara.
4. There was also a police jeep standing near them.
5. After looting the godown and house of S. Mohinder Singh (Mahidera and Mahindera Sons) these people set the building on fire. Pt. Arjan Das was wielding a gun and his son Ravi was having a revolver with him. The police party in the jeep took no action to step these persons in their illegal acts. Instead they were in league with these criminals.
6. In that building eight persons including S. Mohinder Singh were roasted alive. I saw the above said culprits (1) to (7) carrying on the illegal act of looting and burning. I do not know the names of other persons accompanying the aforesaid seven accused but I can recognize them if produced before me. These persons also burnt five trucks belonging to S. Inder Singh Contractor, which were parked in the godown of steel rolling mills just near my house.
7. That on November 2, 1984, a friend Shaukat Ali of D-75, Seelampur, Nai Basti, rescued me and my family and we came to the refugee camp at Shyam Lal College, Shahdara.
8. That on November 3, 1984, my friend Shaukat Ali of D-75, Seelampur, Nai Basti, informed me that my house was completely looted by the aforesaid seven persons mentioned in para (3) above. I lodged a complaint in the P.S. Shahdara.
9. That on August 15, 1985, when I was in my godown situated near my house, Pt. Arjan Das and his son Ravi along with two more persons came to me. They threatened me to kill me if I ever tried to reveal their names to the Commission set up to prove the riots.
I did not report in the police station of the incident just because of life, I have already lost much earlier but no action has been taken whatsoever the fact that I have revealed to them the name of the culprits.
