1984 Affidavits

Affidavit submitted before the Misra Commission

I, Kartar Singh Bawa S/o Late Sunder Singh Bawa, R/o 4154, Arya Pura, Subzi Mandi, Delhi-7, do hereby solemnly affirm and declare as under: -

1. That I had been an old freedom fighter and have been awarded Tamra Patra by the Government of India for taking active part in the freedom struggle of India.

2. That I am Ex-Vice President Sadar District Congress Committee (I), Ex-Executive Member, Delhi Pradesh Congress Committee, Ex-President Arya Pura, Block Congress Committee (I).

3. That myself and all my family members were in a greatly depressed mood to hear the news of assassination of our great leader Mrs. Indira Gandhi.

4. That on 31-10-84, at about midnight I heard a loud noise of miscreants looting the shops situated in Indira Market, Subzi Mandi, Delhi (just in front of my house). We and some of our neighbours came out of their houses and challenged the miscreants looting the shops. We apprehended 5 – 6 persons alongwith the looted property in their hands. We wanted to hand over these people to the police for proper legal action.

5. That just about that time, H.C. Jatav the then Additional Commissioner of Police, Delhi alongwith about half a dozen cops came towards that side.

6. That I narrated him the whole incident and pleaded for providing at least one policeman whom we all shall assist to maintain law and order in the area. But, Jatav did not pay any heed to my request. To our great dismay, he let off the criminals whom we had apprehended.

7. That on 1-11-84, at about 10 A.M., a strong mob of rioters led by 1) Sanjay Jain R/o Arya Pura, 2) Vimal Jain R/o Arya Pura having a coal depot in the same locality, 3) Ram Babu Arya, Editor Diler Paper in Kabir Basti, Malka Ganj, Subzi Mandi, Delhi came to out street. They were armed with deadly weapons. The persons named are well known to me because they are Congress (I) workers as well. I could not even imagine hey had come to attack me and my family. But they had come to my residence to kill us. Somehow, I alongwith my family members managed to hide in a neighbour's house. They raised threatening slogans to liquidate my entire family as we had stopped them and their people in their looting spree the previous night. They searched for us but our neighbours did not oblige them.

8. That these people above stated broke open the locks of two shops belonging to my sons (shops No.T-446 & T-446-B, Indra Market, Subzi Mandi, Delhi) looted the goods and set one of the shops on fire.

9. That they also set on fire the white Fiat car belonging to my cousin Mr. Didar Singh Bakshi, which had been parked in front of my house.

10. That the abovestated persons tried to burn my house as well but, somehow, the neighbours pleaded that their own houses will also get burnt if they burn my house.

11. That I made innumerable calls to the P.S. Subzi Mandi, Delhi which is barely a furlong away from my house for urgent help but nobody came from the P.S. to help us.

12. That ultimately I was left with no option to seek protection in the P.S. Subzi Mandi, Delhi which was then a Refugee Camp where I alongwith my family members remained upto 9th November`84.

13. That many senior police officials visited P.S. Subzi Mandi, Delhi and ascertained from me the name of the culprits which I did tell them but no action whatsoever was taken by them.

14. That I told various high-ups including Jagdish Tytler, M.P., Mrs. Tajdar Babbar, senior police officers that Lakhvinder Singh Brar, Inspector who was there in the Police Station Subzi Mandi, Delhi is a strict police officer who can apprehend the culprits as well as can get the looted property recovered from the culprits and therefore he should be assigned the duty to catch the criminals. But despite repeated requests, Mr. Brar was transferred to some other place. On enquiring about Mr. Brar I was told that the transfer was because of orders from ‘above'.

15. That I wrote registered AD letters to Hon'ble President of India, Prime Minister of India, Home Minister, Lt. Governor of Delhi, I.G. Police, Deputy Commissioner, Police (North) narrating the whole incident and praying to take appropriate action against the guilty and to recover from them the looted property but till now nothing has been done. Photocopy of the letter and photocopies of the police reports lodged with the P.S. Subzi Mandi, Delhi regarding the looting of two shops belonging to my 2 sons namely Jagdeep Singh Bawa and Hardeep Singh Bawa are annexed herewith.
