I, Jasbir Singh Bawa S/o S. Ishar Singh Bawa, R/o Block Q, Qrt. No.1, Malka Ganj, Delhi-110007, do hereby solemnly affirm and declare as under: -
That I belong to a family which, traditionally, is a stauch supporter of Congress Party. My uncle S. Kartar Singh Bawa is a well known figure of Congress (I) in the area of Arya Pura, Subzi Mandi, Delhi-110007.
That the news of the tragic death of our Prime Minister Indira Gandhi sent a wave of shock through the family.
That on the night of 31st October,'84, at about 10:30 P.M., there was lot of noise in the street of my house. Then it appeared that as if many persons were breaking open the locks of my outer grill gate of my house. On peeping through my window I found that it was a strong group of more that 100 persons armed with deadly weapons like knives, spears, iron rods, lathis, etc., and they were trying to forcibly enter into my house.
That at that time, my neighbours came and advised me not to go out but to leave the house from the back door or that hid and take shelter in their house. They told me that there are widespread rumours that Sikhs throughout Delhi are being persecuted and killed. They prevailed upon me not to face the rioters who are bent upon to create trouble and it was impossible to pacify them.
That acting upon the advice of my neighbours, I left my house from the back door and came to my uncle S. Kartar Singh Bawa who resides in Arya Pura, Subzi Mandi, Delhi. The rioters looted my entire house including furniture, household articles belongings, jewellery, electronic goods etc. They also burnt my Ambassador car No.DLI-4149.
That on 31-10-84, at about 12:30 night a group of people started looting the shops in Indra Market, Subzi Mandi, Delhi, after breaking open their locks. I alongwith my uncle and few other persons came out of my uncle's house No.4154, Arya Pura, Subzi Mandi, Delhi and apprehended some culprits indulging in looting of these shops. We wanted to hand over these people to the police for legal action.
That in the meantime, one senior police officer (who I later came to know was H.C. Jatav, Additional Commissioner of Police, Delhi at the relevant time) came to Indra Market, Subzi Mandi alongwith 6 – 7 other police personnel. We narrated him the entire incident and pleaded that one or two policemen must be posted there to maintain law and order. However, Jatav left the place without doing anything. Instead, he let off the culprits whom we had earlier apprehended.
That I came to know in morning of November 1st, 1984, that my house in Malka Ganj was looted by jhuggi dwellers who lived just in front of the street opposite my house. My neighbours also told me that known bad characters of our locality were leading the mob which looted my house.
I lodged a report of the loss and incident to the P.S. Subzi Mandi, vide FIR No.633/84, dtd. 6-11-84 (copy enclosed herewith). The Police told me that they know the culprits very well and my household effects would shortly be restored to me. But till now nothing has been restored to me.
That I made oral and written requests to the Police Officers to take appropriate action but every time false promises are made and nothing has till date been done.
