I, S. Inder Singh Grover, S/o Late S. Nand Singh Grover, aged 66 yrs., R/o 2374/1-A, Mandir Lane, Shadipur, New Delhi-8, do hereby solemnly affirm and declare as under: -
1. That I own property No. T-56 & T-57, Tokri Wallan, Library Road, Delhi-6 which was acquired by Joint HUF in 1948 consequent to migration from Pakistan in 1948.
2. That suit for partition was filed in 1978 in the Delhi High Court (Suit No. 849/78) and the matter was compounded in 1981 and I became owner of four rooms. My wife Prakash Kaur and son S. Jagjit Singh were running their crockery business therein. However, I disposed of two rooms and in the remaining two rooms they continued their business.
3. That my wife and son started another business of commercial institute and photo state at Patel Nagar, New Delhi and reduced their visits to the crockery shops. In the meantime following the death of Indira Gandhi, Hon'ble Prime Minister of India, anti-Sikh riots broke out in Delhi as well as other parts of India.
4. That our crockery shops were looted by our hostile neighbours and also illegally occupied premises also forcibly which are till date in their possession in connivance with the local police and councilor. Household and crockery goods losses were Rs. 25,000/-. FIR was lodged in November '84, (photocopy attached). Compensation was granted only Rs. 2,750/-. Our business and property too have been lost.
5. That not only this our commercial institute and Photostat shop were too looted and burnt to ashes. However, a loan of Rs. 64, 500/- was sanctioned against house mortgaged by the Indian Overseas Bank, Rajindra Place, New Delhi in the name of wife of the deponent. The said bank went to the court for recovery of the said loan from the deponent and his wife.
The court passed decree amounting to over two lacs of Rupees. It may be mentioned here that loans upto Rs. 50,000/- together with interest were waived of in toto and our loan being more than Rs. 50,000/- by just Rs. 14,500/-, we had to pay lacs of Rupees (photocopies of court decree attached).
6. That your good self can make out as to how we suffered once in 1947 Partition of India and again in November'84, riots and afterwards due to mal-administration. It is respectfully prayed: -
i) To restore our property no. T-56 and T-57, Tokri Wallan, Library Road, Delhi occupied forcibly by the rioters in November 84 riots.
ii) To waive of the loan of Rs. 64,500/- and the interest thereof and direct the above said bank to refund the amount already paid by the deponent to discharge the said loan as per the court orders.
