1984 Affidavits

Affidavit submitted before the Nanavati Commission

I, Davinder Singh S/o S. Gurdit Singh, R/o T-1704, Desh Bandhu Gupta Road, Anand Parbat Chowk, New Delhi-110005, do hereby solemnly affirmation state and declare as under: -

1. That I was residing in the abovesaid house along with my other brothers with their respective families, in separate portions in the same house. We were also having a shop at the Ground Floor of the same property.

2. That on 31-10-84, at about 9 pm, I was beaten by some of Non Sikh persons near the Bali Nursing Home at Karol Bagh. However, I rescued by some of the employees of the said nursing home and took me inside the nursing home. I was treated there in the nursing home.

3. That on 1-11-84, at about 10 – 11 am, our shop was attacked by the rioters and started pelting stones on us and we were throwing the same on them. After looting the shop by the rioters the same was set on fire. One two-wheeler scooter was standing in the compound of our house. The same was also caught fire and due to blast in the scooter the fire was spread.

4. That since the Ground Floor portion was in flames hence we went to the roof of the house i.e. on 2nd Floor and after some time we went to the Gurdwara after crossing the wall at the 2nd Floor of our house.

5. That from roof of the house I along with other family members saw that one SI Tyagi was standing in uniform along with Dharam Dass Shastri, the then Congress (I) MP, near our house. They were provoking the mob to indulge into the said illegal acts in more aggressively.

6. That when we were inside the Gurdwara premises I also saw the said SI Tyagi on the roof of our house along with rioters.

7. That my Bhabi Jasbir Kaur (W/o our brother of S. Raghubir Singh) had requested to said SI Tyagi to help them and to take action against these rioters but the said SI Tyagi told my Bhabi that nobody will help the Sikhs for at least 4 days.

8. That in this illegal action of the rioters my brother S. Raghubir Singh suffered injuries in pelting stones as well as burn. His feet and legs, blow the knees, were badly burnt. We could not able to provide any medical assistance to him till 3-11-84.

On 4-11-84, we were able to some medical assistance to him threw one Hindu family residing just near the Gurdwara where we had taken shelter, as Gurdwara was also burnt by the rioters subsequently.

9. That ultimately on 13-11-84, my brother S. Raghubir Singh was succumbed to the injuries sustained by him during illegal action of the rioters in the hospital.

10. That I have received only Rs.10,000/- as compensation towards damage of property and as a some of Rs.2,000/- as compensation towards injuries sustained by me.

11. That no compensation was given to our Bhabi i.e. wife of brother of S. Raghubir Singh towards his death. She had tried her level best to get the announced compensation but she is still even today fighting for the same from pillar to post.
