Statement submitted before the Nanavati Commission

I am filing an affidavit today. It contains what I want to say before this Commission. The affidavit is taken on record and marked as Exhibit No.43/1. SHO Bhaskar and two policemen who had accompanied him had fire arms with them I knew SHO Bhasker. My father had given a complaint in writing to the police but no offence was registered.

My father had filed an affidavit before Justice Ranganath Mishra Commission of Inquiry. My father had appeared before IAS officer who had conducted an inquiry against SHO Bhaskar. On 2.11.84 SHO Bhaskar had come to our house and enquired about our safety and told us he was ready to help them and if necessary he will take us to a safer place.

On 1st November, 1984 SHO Bhaskar had told my father, while he was proceeding towards his shop, not to go there as the situation in the Lal Quarter Area was tense and serious. Some two or three small shops were also destroyed in Lal Quarter Area. Mainly damage was caused to our shop. No curfew was imposed in our area.

The army had come to our area on 3rd November, 1984 after police inspector Mr Kapoor had searched our house. It is true that about ½ a Kms. away from our house the owners of Swaran Cinema were staying. I do not know if anyone from the mob who had collected near his house. Owners of Swaran Cinena had died as a result of firing by the owners of Swaran Cinema. I say that six persons of that family were killed by the mob and their houses were burnt.

My father had appeared in the inquiry held against Mr Kapoor. My father did not have any license fire arm at the time of incident. He had surrendered it about 6 to 7 years before the incident. I say that the people believes that my father had a licensed gun. It is not correct to say that Mr Kapoor had come to request my father to surrender the fire arms. I had read the statement given by my father before Justice Ranganath Mishra Commission of Inquiry.

We had gone to the police station for lodging a complaint about the burning of our shop. The police had told us that a general complaint in that behalf was already taken down by the police. It is not correct to say that the police had recorded a statement of my father in connection with that offence.
