1984 Affidavits

Affidavit submitted before the Nanavati Commission

I, Kultar Singh Lamba S/o Late Harbans Singh Lamba aged 58 yrs. R/o C-6, Akal Garh, Fateh Nagar, Jail Road, New Delhi-18, do hereby solemnly affirm and declare as under:-

1. That during Oct./ Nov.'84, I was residing at the aforesaid address along with the following family members:-

a. Hanbans Singh, Father (73 yrs.)

b. Sarabjeet Singh, Son (15 yrs.)

c. Gagandeep Kaur, daughter (9 yrs.)

d. Amarjeet Kaur, Wife (39 yrs.)

2. That no incident of violence, killing etc. took place in our area on 1-11-84 and 2-11-84 as the area is inhabitated by many Sikh families.

3. That my house is situated on the main road and on the roadside. I have a showroom which is an agency of Enfield Motorcycle.

4. That on 3-11-84 at about 12 Noon I heard a loud noise coming from DTC Depot, Hari Nagar, Delhi. I climbed the terrace of my house and saw that at a distance of about 2 furlongs from our house, on the main road leading to Fateh Nagar, an armed mob having iron rods in their hands were menacingly coming towards our side. One jeep was leading this large group of about 1000 violent mob. After some time this mob came near the petrol pump where two private buses belonging of Sikhs residing there were set on fire.

5. That I got frightened and came down. By that time many Sikh families gathered in the area. Fear and depression was writ large on their faces. However some Sikhs advised that instead of remaining confined to their houses, they should come out and jointly defend themselves from the imminent danger to their lives at the hands of the violent miscreants who were coming closer every moment a very . In short time about 300 – 400 Sikhs gathered there and stood on the main road, Fateh Nagar.

6. That when the above said violent mob came nearer, I found that the jeep leading the mob was carrying some white inflammable powder which was being given to the miscreants. This powder when thrown on any object would catch fire immediately.

7. That when the armed miscreant saw a group of 300 – 400 Sikhs standing on the main road, Fateh Nagar they stopped about one furlongs away. The miscreants in the mob kept on shouting loudly but could not dare to proceed toward our colony. After about one hour the said mob retreated and the jeep leading them also went back.

8. That about 2 pm a police van carrying about 15/20 policemen came there. One police jeep also arrived at the scene. One police officer came out and ordered the policemen to apprehend the Sikhs. The policemen forcibly started intruding into the houses of Sikhs. At this the Sikhs scattered were and there and ran to their houses.

9. That 4 – 5 policemen entered our house. I concealed myself in the showroom and thus escaped the fury of policemen. My family members (wife and children) concealed themselves in the house.

10. That my father who was 73 yrs old was lying in bed in one room four – five policemen caught hold of him and started beating him without any provocation from his side. The policemen, while beating brought my old aged father out of the house and took him to the police station Tilak Nagar. I saw the policemen hitting my father with rifle butts. While leaving our house, the policemen also took along with them our Single Barrel Licensed Rifle which was with my father since 1944, which he got for self defence.

11. That later on the police arrested my father and implicated them in a false case Under Section 307 IPC (Attempt to murder policemen). As my father had been seriously injured by the policemen as stated above and proper medical care was not provided to him in jail, an application was moved on 9th Nov.'84, for his medical examination in Court and it was thereafter that some medicine were given to my father.

12. That my father was released on bail by the Court on 12th Nov.'84. Till then he remained in Central Jail, Tihar, New Delhi.

13. That thereafter my father came to house. But he could hardly walk because of acute pain in legs and feet due to severe beatings by the police as stated above.

14. That my father expired on 13th June 1985.
