I, Jitender Kaur W/o S. Gurcharan Singh R/o FU-34, Vishakha Enclave, Pitampura, Delhi, do hereby solemnly affirm and declare as under:-
1. That I had been allotted D.S.I.D.C. shed in February, 1977 during Inter National Women's Year 1977 in the Brain Drain Scheme for unemployed Graduates.
2. That I had started work in various Food Products under the name and style of "Oriental Food Products" and was dealing in Food items like Jams, Ketchup, Vinegars, Syrups, Pickles, Cocktails etc. and was also exporting the goods to Hong Kong also.
3. That in 1984 riots, my unit was looted and burnt. I suffered a heavy loss, mental depression and left for Jallandhar with my family and returned in January, '85. I could not file the FIR as the date was over, but I did send a few letters to the Lt. Governor, Delhi State without any response. Due to great mental shock, heavy financial loss, due to unit remaining closed. The semi-finished products like pulps, puries having been spoiled were thrown away and the finished products like Jam bottles were damaged in bulk, which became unfit for sale, especially window paws, and damages to the building etc. during the period were beyond recovery. All these losses / damages upset my mental / physical structure to such an extent that became afraid to visit my unit for which I had spent my all sources services.
4. That though mental depression was beyond my control and till date was not free from it, even after continued medical treatment and under compelling circumstances.
5. That I applied to DSIDC to give me rebate as per Central Interest Subsidy Act, 1992, but the DSIDC has refused to give me interest subsidy and I am also ready to pay all the dues of the DSIDC after deducting the interest as per the Act under the RBI directions to the financial institutions.+
6. That instead of taking steps to rehabilitate my sick unit, DSIDC refused to give me benefit under the Central Interest Subsidy Act, 1992, which are applicable for the 1984 riots victims. I after deducting the interest offered DSIDC to take the loan amount of Rs.2,40,000/- from the Riot Hit Unit. DSIDC vide their letter dated 19-2-96, after keeping the 2 cheques for about 3 months returned the said cheques. I arranged the said loan amount from my relatives and friends to repay the DSIDC.
7. That I had treated the DSIDC as my parent organization even after suffering so much heavy loss, but their refusal to accept my payment for Rs.2,40,000/- when they accepted such payments from other Riot hit units has put me in compelling circumstances to fight to my fundamental rights.
8. That I humbly pray before the Hon'ble Commission to do justice to me by getting me my legal rights for the shed treating the payments already made as full and final payments towards the cost of the shed & providing me loan facilities at reasonable interest to be paid in instalments, because I am not able even to get any loan, what to speak of Rs.2,40,000/-, which was refused by DSIDC in 1996. Because If a decision regarding final cost of the shed had been taken at a proper time the accumulated dues payable by my unit could be arranged / managed when unit was functioning. A sick unit cannot be granted loan etc.
